As of November 2025, the Waterview Property Owners Association has issued multiple warning letters regarding FDEP violations identified as non-permitted modifications to the Greenbelt by adjacent property owners. The WPOA Greenbelt is zoned as Environmentally Sensitive, and is bound by regulations of FDEP, Charlotte County, and the Army Corps of Engineers. All changes to the Greenbelt made by adjacent property owners require prior written authorization from the WPOA as well as subsequent regulatory approval. This process is strictly enforced.
The Waterview POA fully cooperates with the Army Corps, Charlotte County, and the Florida DEP in completing investigations, issuing notices of violation(s), and establishing steps for remediations pertaining to the Greenbelt.
Strict enforcement of rules related to the WPOA Greenbelt protect property owners from potential fines and remediation expenses. Unresolved violations may result in fines and/or other punitive action from the Waterview Property Owner's Association, up to and including foreclosure.
The ECC assists lot owners in the process of obtaining the required authorizations to make changes to the Waterview Greenbelt, in communicating with regulatory agencies in violation management, and the ECC will continue to assist owners as needed.
