Waterview (Section 94) must comply with SGC deed restrictions since SGC is the master HOA. All plans for construction must be approved in advance by the Waterview Property Owners Association (Environmental Control Committee - ECC). The Residential Application for Single Family Home, Detached Garage and/or Remodel can be found on this web site under Documents.
Since the Greenbelt is owned by the Waterview POA, Property Owners must submit a Waterview Greenbelt “Request for Use Form”. You can download this form under the documents section of this website. In addition, depending on the nature of the changes, permits may be required from Florida Department of Environmental Protection (DEP), Army Corp of Engineers, and/or Charlotte County. Unauthorized dredging or filling of wetlands or other surface waters is a violation of Florida law. The DEP may require complete restoration of the un-permitted activity and can assess monetary fines of up to $10,000 daily, per violation. The DEP also can take enforcement action against a contractor or agent responsible for a violation. Other local, state and federal agencies also may assess penalties or fines for un-permitted activities. You need to hire a professional environmental consultant to assist you in determining whether your property or project area contains wetlands or other surface waters. Contact FDEP to perform a verification of a wetland determination previously indicated by a third party for your property. Let us know what Committee you are interested in and include a one-sided information sheet, or information in the body of the email, which may include a description of your background, education, qualifications, and any other factors deemed relevant.
While membership in Waterview POA is mandatory, membership in SGC HOA is optional. It costs $120 per year and you can sign up on their web site www.southgulfcovefl.org. We encourage everyone to belong to both organizations since they perform very different worthwhile functions for the neighborhood. Everyone is eligible to rent the clubhouse for $250 for non-HOA members, but SGC HOA members can rent the clubhouse for only $25 per event.
Checking the SGC web site at www.southgulfcovefl.org or the Conservancy & Community Trust puts out a biannual newsletter. You can see the news letter on their web site https://southgulfcovecct.org/ as well. We recommend joining the South Gulf Cove HOA for $120 per year to get full access to their web site.
